Appearing on his wife Peta Murgatroyd's podcast The Penthouse with Peta in October, Maks criticized Jan's foxtrot with partner Jen Affleck. He said, "Jan has absolutely no business being a pro on Dancing with the Stars. There's zero foundation, technique, quality, understanding of the partnership. Bro, I'm getting emotional. It is absurd. And this is unreal how blind we have to be and, God forbid, say what's obviously there. He had no idea what foxtrot is supposed to look like. How are you gonna expect him to teach it and deliver that message in a format that is completely different from even ballroom dancing?

We had this criticism weeks ago, and I'm like, 'Bro, is anybody gonna explain it to him?' And then we saw one dance that delivered some sort of direction, like, 'Okay... he is going the right direction as long as he has that help and foundation.' And then it just off the cliff. Jan, whoever he is, I have zero against him whatsoever... No way this was a missed opportunity."

He then agreed with Peta when she said that Jen had a "major disadvantage" with Jan as her partner. However, they also both said it was "not Jan's fault."

In response, Jan told Entertainment Tonight, "I have no comment on that. Look, I got all the love on this show, all the pros, from all the judges also. Like, everyone gave me so much love. Whoever is saying outside, trying to stay relevant, and spreading the hate, this is not a way to do it. And I never will spread or take the hate. So it's just [going in one ear and out the other]."
